Page 353, line 43, strike "providers." and insert:

"No individual with complex behavioral diagnoses or a SIS score of Level 7 Tier 4 shall be discharged from a state training center until the DOJ settlement Agreement Independent Reviewer can report that the Commonwealth has sufficient behavioral specialists and crisis services to meet the needs of its intellectually disabled population.  For training center individuals who choose on their behalf, to continue ICF/ID placement, sufficient ICF/ID capacity shall be developed to accommodate their choice, in accordance with federal laws and regulations.  No training center regional support center shall be closed without a comparable quality local replacement to continue the full availability of medical, dental, behavioral, psychiatric and other services to those who receive such services at the center."



Explanation

(This amendment prohibits the discharge of individuals from state training centers with complex behavioral health needs until the Independent Reviewer of the state settlement agreement with the U.S. Department of Justice reports the Commonwealth has sufficient behavioral specialists and crisis services to meet the need of the intellectually disabled population. In addition, the language provides that for those individuals that choose to reside in a training center then capacity shall be developed to accommodate that choice. The language also prohibits the closure of training center regional support centers unless the services are available in the community to meet the needs of individuals.)
