"YYY.  Effective July 1, 2019, the Department of Medical Assistance Services shall amend the State Plan for Medical Assistance to eliminate the requirement that lawful permanent aliens that have resided in the United States for five years have 40 quarters of qualifying work to be eligible for Medicaid.  The department shall have authority to implement this change prior to the completion of the regulatory process."



Explanation

(This amendment provides $6.6 million from the general fund and $16.6 million from federal Medicaid matching funds in fiscal year 2020 to eliminate the 40 quarter work requirement for lawful permanent aliens that have resided in the United States for five-years. Virginia is one of only six states that requires legal aliens to meet the 40 quarter (10 year) work requirement in order to be eligible for Medicaid.)
