"L. For any convicted felon whose sentence includes a term of confinement in a state correctional facility and/or a period of time under state community supervision, and who has violated the terms or conditions of their suspended sentence, probation, or parole, and has been placed in a local jail, either (i) the inmate shall within 10 days be removed from the local jail by the Department of Corrections and housed in a state correctional facility; or (ii) the Compensation Board shall compensate the locality for the cost of maintaining the prisoner in a local correctional facility at the rate for state-responsible inmates established in subsection E.2. at $15 per inmate beginning on the eleventh day."



Explanation

(This amendment includes language that expands the number of inmates for whom localities receive the state-responsible jail per diem payment rate of $15 and provides $250,000 GF the second year as a placeholder estimate for the fiscal impact of the language. The language establishes that, for any convicted felon whose sentence includes time in a state correctional facility or under state community supervision and who has been placed in jail due to a violation of the terms of their community supervision, the Department of Corrections shall either relocate the inmate to a state correctional facility within 10 days or the locality shall begin receiving $15 per day, as opposed to the $5 per day rate for local-responsible inmates.)
