"W. Out of this appropriation, $100,000 the first year and $410,000 the second year from the general fund shall be provided to fund one or more nonprofit organizations to provide legal services to parents and caregivers subject to an assessment or investigation by Child Protective Services, or contemplating entering into a Parental Child Safety Placement Agreement, pursuant to § 63.2-1533(B)(3) Code of Virginia.  Attorneys providing the legal services must be members in good standing of the Virginia State Bar, have previous training (or receive training within six months of hire) in providing legal representation in child-dependency cases; and receive specific training in providing pre-petition legal representation of parents in such matters. While the focus of the program is to reduce the number of cases going to court, attorneys may continue to represent a parent if the case does proceed to court."



Explanation

(This amendment provides $100,000 GF and 1.0 position the first year and $410,000 GF and 0.5 positions the second year to fund one or more nonprofits to provide legal services to parents and caregivers subject to assessment or investigation by Child Protective Services, or contemplating entering into a Parental Child Safety Placement Agreement. Funding in the first year will fund 1.0 position at the Department of Social Services (DSS) to to develop the processes to implement the pilot, including entering into a Memorandum of Understanding with the eligible Qualified Legal Service Providers (QLSP). Funding in the second year will support 0.5 positions at DSS to administer the funds and receive quarterly and annual reports from the QLSPs; and to summarize these reports and statistics relating to the program to the General Assembly.)
