Page 467, after line 42, insert:

"E.1. The Secretary of Natural and Historic Resources shall convene a workgroup to study the requirements for and historical implementation of the Water Quality Improvement Fund pursuant to §10.1-2128, Code of Virginia.

2. The workgroup shall make recommendations on the Water Quality Improvement Fund, to include the (i) organizational structure in the Code of Virginia and Appropriations Act, (ii) the disposition of funding, (iii) the feasibility of the incorporation of the Stormwater Local Assistance Fund, (iv) grant approval guidelines including the cost-effectiveness of practices funded, (v) grant agreement terms, (vi) annual reporting requirements, (vii) potential improvements to the current funding needs assessments, and (viii) outdated or unnecessary requirements.

3. The recommendations relating to the organizational structure of the Water Quality Improvement Fund in the Code of Virginia and the Appropriations Act shall include streamlining the fund and sub-fund structure, updating terminology and structure to enhance transparency, and deconflicting language in the Code and Appropriations Act. In deconflicting the Code of Virginia and Appropriations Act language, recommendations shall be made for items most appropriate for inclusions in the Code and those most appropriate for inclusions in the Appropriations Act.<

4. The recommendations relating to the disposition of available funding shall include mandatory deposits between sectors, discretionary deposits between sectors, the Water Quality Improvement Fund reserve, the use of interest including for administrative costs, the Natural Resources Commitment Fund, funding for technical assistance, and the division of funding between the Chesapeake Bay and Southern Rivers watersheds.

5. The workgroup shall include, but not be limited to, representatives from the Department of Conservation and Recreation, Department of Environmental Quality, Virginia Association of Soil and Water Conservation Districts, Virginia Farm Bureau Federation, Virginia Association of Municipal Wastewater Agencies, Virginia Municipal Stormwater Association, Chesapeake Bay Commission, and the staff of the House Appropriations and Senate Finance and Appropriations Committees.

6. The findings and recommendations of the workgroup shall be reported to the Chairs of the House Committees on Appropriations and Agriculture, Chesapeake and Natural Resources, and the Senate Committees on Finance and Appropriations and Agriculture, Conservation and Natural Resources, and the Chair of the State Water Commission no later than November 1, 2026."



Explanation

(This amendment directs the Secretary of Natural and Historic Resources to establish a workgroup to review the Water Quality Improvement Fund. The workgroup is directed to review and make recommendations relating to the Water Quality Improvement Fund, including its organizational structure in the Code of Virginia and Appropriations Act, the disposition of funding, the feasibility of the incorporation of Stormwater Local Assistance Fund, and other topics as directed by the amendment. The recommendations of the workgroup are required to be submitted to the Chairs of specified House and Senate committees and the State Water Commission by November 1, 2026.)
