"5. Out of the Criminal Fund appropriation, $1,800,000 the second year from the general fund shall be provided as grants to localities that have demonstrated efforts or intentions to implement counsel at first appearance.  The Office of the Executive Secretary of the Supreme Court shall prescribe guidelines and qualifications for the distribution of these monies, with priority given to courts in localities that are identified as "high" in fiscal stress on the most recently available report on local fiscal stress prepared by the Commission on Local Government within the Department of Housing and Community Development."



Explanation

(This amendment provides $4.0 million the second year from the general fund for costs associated with House Bill 2217, relating to the court appearance of a person not free on bail. Specifically, $2.2 million of the amounts provided herein are estimated for costs to provide court-appointed counsel at first appearance, and $1.8 million is for a new grant program to localities who demonstrate both need and intention to provide counsel at first appearance. This is a placeholder amendment until the final fiscal impacts are known)
