"K. Out of this appropriation, $100,000 the first year and $410,000 the second year from the general fund is provided for the Department of Social Services to establish a pilot program to provide legal services to parents and caregivers whose children are at risk of entering foster care. Any non-profit legal organization that has been approved by the Virginia State Bar as a qualified legal services provider may apply for funding and enter into a memorandum of understanding with the Department of Social Services to provide legal services to parents who are subject of an investigation or assessment by Child Protective Services and to parents contemplating entering into a Parental Child Safety Placement Agreement pursuant to § 63.2-1532, Code of Virginia. The practicing attorneys through the qualified legal services provider must be members in good standing of the Virginia Bar, have previous training or receive training within six month of hire in providing legal representation in child-dependency case, and receive specific training in providing pre-petition legal representation of parents in such matters.  The Department of Social Services shall report annually to the Chairs of the House Appropriations and the Senate Finance and Appropriations Committees by December 1 detailing the funds awarded to the legal organizations and results of the pilot program."



Explanation

(This amendment provides $100,000 the first year and $410,000 the second year from the general fund and 1.00 FTE the first year and 3.50 FTEs the second year to establish a pilot program to provide legal services to parents whose children are at risk of entering foster care in order to reduce the number of children who enter foster care. Any non-profit legal organization that has been approved by the Virginia State Bar as a qualified legal services provider may apply for funding and enter into a memorandum of understanding with the Department of Social Services to provide legal services to parents who are subject of an investigation by Child Protective Services and to parents contemplating entering into a Parental Child Safety Placement Agreement. Funding is also included to support new positions at the Department of Social Services to administer the funds and to receive and review quarterly and annual reports from the qualified legal services providers.)
