"OOOOO.  The Department of Medical Assistance Services shall have the authority to amend the Developmental Disability Waiver programs and the Commonwealth Coordinated Care Plus waiver to allow respite care when a waiver individual has a Legally Responsible Individual (LRI) as a paid attendant and multiple adults providing any portion of unpaid care to a waiver member who is a minor.  The department shall have the authority to implement necessary changes upon federal approval and prior to the completion of any regulatory process undertaken in order to effect such change."



Explanation

(This amendment adds $4.5 million from the general fund and $5.2 million from nongeneral funds to provide respite care when a child receiving services through any of the three Developmental Disability waivers or the Commonwealth Coordination Care Plus waiver has a parent or spouse paid caregiver and unpaid adult caregivers. Parents and spouses of minor children receiving Medicaid waiver services are Legally Responsible Individuals that are able to be paid for some portion of care provided to their minor children. This provision has been in effect since the COVID 19 pandemic. However, respite care services are not available when a the primary caregiver is also the paid attendant. Language would allow for respite care to become available.)
