"R.1. Out of this appropriation, $2,500,000 the second year from the general fund is provided to the department for an affordable housing development pilot program. The purpose of the program shall be to provide grants to eligible recipients in accordance with the criteria and guidelines described in this paragraph R. Grant funds shall be distributed to eligible recipients pursuant to a contract executed between the department and an organization exempt from taxation under 501(c)3 of the Internal Revenue Code with subject matter expertise in providing, constructing, or renovating affordable housing. Funds provided by the Program shall only be used for initial development costs of converting existing underutilized buildings or land into affordable housing for low-income households. The contract shall require the organization selected to facilitate this program on behalf of the department to submit a report detailing the distribution and use of such funds for affordable housing development purposes on an annual basis.

2. For the purposes of this paragraph: "Eligible recipient" means a nonprofit entity which is an owner of real property and is exempt from taxation under 501(c)3 of the Internal Revenue Code. “Initial development” shall include market studies, feasibility assessments, zoning analyses, and preliminary design concepts, but shall not include any type of construction cost. “Low-income households” and “affordable” shall have the same meaning as provided by § 15.2-2305.1 of the Code of Virginia.

3. The department shall develop criteria and guidelines for the pilot program on or before August 1, 2025, which shall include a method for prioritizing funding for eligible recipients without the means to fund such activities themselves. The department shall report on or before May 1, 2026, to the General Assembly the results of this pilot program. The report, at a minimum, shall contain information on the number of applicants, number and dollar amount of grants awarded, and initial development activity funded."

(This amendment provides $2.5 million for a grant program to support the development of underutilized buildings or land into affordable housing for low-income households. Grant funds can be used for initial development costs such as market studies, feasibility assessments, zoning analyses, and preliminary design concepts.)
