"e. Any retired sheriff of a city with a population of fewer than 100,000 as determined by the 1990 census of the population of the United States who did not receive the 4.35 percent salary increase as provided for in Item 528 of Chapter 921, 1996 Act of Assembly, shall be given credit for such salary increase and his retirement benefits shall be recalculated and adjusted retroactive to his retirement data."

(This amendment permits the Virginia Retirement System to adjust the retirement benefit of a former sheriff to reflect the December 1, 1996, salary increase granted by the General Assembly. Due to a downward change in population, this sheriff was ineligible for the salary increase. This was not the intent of the General Assembly, but the Compensation Board did not have the authority to grant the salary increase.)
