A.  The requirements of §4-5.07 shall not apply to this appropriation.
B.  Prior to the allotment of the funds provided for the Roanoke Higher Education Center project in Item 572 of this act, the Roanoke Higher Education Center shall submit a plan to the Secretary of Education, with copies to the Council of Higher Education and the Chairmen of the Senate Finance and House Appropriations Committees.  The plan shall include memoranda of understanding between the Roanoke Higher Education Center and each entity that plans to participate in the facility, detailing the number of square feet, annual lease and operating costs to which each entity has agreed.  The plan shall be due by August 1, 1998, with action by the Secretary of Education no later than September 1, 1998.

Explanation
(This amendment creates in the Appropriation Act the Roanoke Higher Education Authority. The funds appropriated will be used to operate the Roanoke Higher Education Center, the development of which is funded in Central Appropriations. Public and private higher education institutions from throughout the Roanoke Valley will provide credit and non-credit instruction at the Center.)
