"l. 1) Out of this appropriation, an amount estimated at $11,009,617 from the general fund is provided for the state's share of adding approximately 500 elementary teachers in the first year and $40,985,904 from the general fund is provided for the state's share of adding approximately 1,500 elementary teachers in the second year.  In order for any school division to receive its proportionate share of funding for these additional teachers, the local superintendent must certify to the Department of Education that the number of elementary teachers in the division will increase by at least as many new teachers as are funded in this initiative as defined in paragraphs 1. 2) and 1. 3) of this item.

2)  School divisions will have met this requirement in fiscal year 1999 if one of the following two provisions is met:  
a) the number of elementary teachers under contract in fiscal year 1999 exceeds the number of elementary teachers under contract in fiscal year 1998, adjusted for those positions added or lost pursuant to the Standards of Quality and the Primary Class Size program.  The division must exceed this adjusted fiscal year 1998 base by at least the number of teachers allocated to that division through this initiative for fiscal year 1999; or
b) the school division's pupil to teacher ratio is equal to or below 15 to 1 in fiscal year 1999.

3)  School divisions will have met this requirement in fiscal year 2000 if one of the following two provisions is met:
a) the number of elementary teachers under contract in fiscal year 2000 exceeds the number of elementary teachers under contract in fiscal year 1999, adjusted for those positions added or lost pursuant to the Standards of Quality and the Primary Class Size program.  The division must exceed this adjusted fiscal year 1999 base by at least the number of teachers allocated to that division through this initiative for fiscal year 2000; or
b) the school division's pupil to teacher ratio is equal to or below 15 to 1 in fiscal year 2000.

4)  For the purposes of this initiative, a teacher is defined as any classroom teacher, reading specialist, or technology specialist who has direct contact with students in the classroom.

5)  School divisions that wish to participate in this program shall certify their intent to participate to the Department of Education no later than September 15 in each year."


Explanation
(This amendment provides funds for 500 additional elementary teachers in the first year and 500 more, in addition to the 1,000 teachers provided in the second year in the introduced bill, in the second year. The amendment sets out the conditions under which school divisions will be able to qualify for the funding. Finally, the amendment assumes a 5 percent non-participation rate in the first year and an 11.68 percent non-participation rate in the second year, based on an estimate of the number of teachers for which school divisions will qualify.)
