"D. Performance-based salary increases shall be provided to employees as set out in subparagraphs 1 through 4 of this paragraph, effective November 25, 1999.  The Department of Personnel and Training shall implement stepless salary ranges prior to November 25, 1999.
Subject to specific guidelines to be developed by the Department of Personnel and Training for employees subject to the Virginia Personnel Act, transfers from this item shall be used to effect salary increases as follow:
Employees rated "Fair But Needs Improvement" or "Does Not Meet Minimum Expectations" shall not receive a salary increase.  
Increases for employees below their respective salary range maximum shall be determined by their performance on the following basis:
Exceptional Performance 5%-7%
Exceeds Expectations 3%-5%
Meets Expectations 1%-3%
1.  Each agency shall adjust the increases within the ranges of percentages outlined above according to the number of employees with each performance rating, so that the average increase for the agency does not exceed 3.55 percent.  
2.  All employees in an agency with a particular rating shall receive the same percentage increase, except that the salary of any employee rated "Meets Expectations" or above shall not be below the new range minimum.
3. Employees at their respective range maximum who are rated "Exceptional" may be granted a one-time payment equivalent to 5 percent of their annual salary.
4. Any agency which employs criminal justice officers may submit a plan to the Department of Personnel and Training for approval to implement, for such employees, increases according to an alternative to those specified above.  In addition, the Department of Transportation and Institutions of Higher Education may submit for approval a comprehensive performance pay plan for their employees.
For those employees listed in subparagraph 5 of this Paragraph base salaries shall be increased by 2.25 percent on December 1, 1999.

Explanation
(This amendments provides for a 1.25 percent across-the-board salary increase and one step (2.25%) increase the first year for state employees. Funding equal to a 3.55 percent salary increase is provided in the second year to fund the Employee Incentive Pay Plan.)
