"Q. The Department of Medical Assistance Services shall seek a waiver from the Health Care Financing Administration to allow for waiving charges for nursing home residents that exceed the current 18-day limit on nights away from facilities in which a majority of their patients are younger than age 65."

Explanation
(This amendment directs the Department to seek a waiver from nursing home charges for residents that exceed the current 18-day limit on nights away from facilities. At the Virginia Home, where mostly younger persons reside, a charge of $85 is assessed to the resident for each night in excess of 18 per year spent away from the facility. A waiver from patient charges would allow these persons to spend additional time away from the facility without being charged.)
