Authority: Title 44, Chapter 3.2 and Title 45.1, Chapter 13, Code of Virginia.


A.1. The amount for Disaster Recovery is from all funds of the state treasury, not constitutionally restricted, and is to be effective only in the event of a declared state of emergency or authorization by the Governor of the sum sufficient, pursuant to § 44-146.28, Code of Virginia. Any appropriation authorized by this item shall be transferred to state agencies for payment of eligible costs according to written directions of the Governor or by such other person or persons as may be designated by him for this purpose.


2. Any amount authorized for expenditure pursuant to § 44-146.28, Code of Virginia, shall be paid to eligible jurisdictions in accordance with guidelines and procedures established by the Department of Emergency Services, pursuant to § 44-146.28, Code of Virginia.


B. In the event of a Presidentially declared disaster, the state and local share of any federal assistance, hazard mitigation, or flood control programs in which the state participates will be determined in accordance with the procedures in the "Commonwealth of Virginia Emergency Operations Plan, Peacetime Disasters," promulgated by the Department of Emergency Services. The state share of any such program shall be no less than 10 percent.


C. The amount for Emergency Coal Production Operations is for carrying out the purposes of and subject to the conditions stated in Chapter 22, Acts of Assembly of 1950, which authorizes the Governor to take certain steps in the event of a coal production emergency.
