A. Out of the amounts for rail development programs $1,500,000 the first year and $1,500,000 the second year may be allocated for use by the Commonwealth Transportation Board in order to acquire, lease, improve, or assist other appropriate entities to acquire, lease, or improve railways for passenger and freight rail transportation purposes which the Board determines are for the common good of the Commonwealth or a region of the Commonwealth. The Board may, in its discretion, exceed the twenty-five percent limit contained in § 33.1-221.1:1 E, Code of Virginia, in individual cases where the Board determines that such action will promote industrial development.
B. Out of the amounts available from federal ISTEA set-aside safety funds (Section 130) in the second year, $125,000 shall be provided to install constant-warning time devices at certain specified rail crossings in the City of Manassas.
