"QQQQQ. Effective July 1, 2026, the Department of Medical Assistance Services (DMAS), related to reimbursement to Intermediate Care Facilities for Individuals with Intellectual Disabilities (ICF/IID), which shall be retrospective on the basis of reasonable costs in accordance with Medicare principles of reimbursement, shall amend its regulations to allow non-state facilities to be limited to a ceiling based on the highest as filed rate paid to a state-operated ICF/IID the preceding state fiscal year. By September 1, 2026, DMAS shall provide the Chairs of the House Appropriations and Senate Finance and Appropriations Committees an estimated cost to implement a new reimbursement rate."



Explanation

(This amendment provides $1.5 million GF and $2.0 million NGF the first year and $2.1 million GF and $2.9 million NGF the second year for the Department of Medical Assistance Services to update its regulations to align funding for ICF-IIDs with the current per diem rate paid to South Eastern Virginia Training Center, the only remaining state facility of this type. Current regulations set the ceiling at the rate paid in 2012 to the state's Northern Virginia Training Center and adjusted by inflation thereafter.)
