Out of this appropriation $49,001,993 the first year and $51,816,993 the second year from the general fund is provided to effectuate the provisions of House Bill 1263 of the 2026 General Assembly. Out of the amounts provided in this paragraph, the Director of the Department of Planning and Budget shall transfer $22,938,611 the first year and $22,938,611 the second year to the Department of Medical Assistance Services; $439,592 the first year and $439,592 the second year to the Office of the Attorney General; $1,484,113 the first year and $984,113 the second year to the Department of Human Resources Management; and $469,000 the first year and $469,000 the second year to the Department of Labor and Industry. Out of the amounts in this paragraph, $3,315,000 the second year is provided to update the Cardinal Human Capital Management (HCM) system. The remaining amounts shall be distributed by the Director of the Department of Planning and Budget to address staffing needs across all state agencies as a result of the provisions of House Bill 1263 of the 2026 General Assembly."



Explanation

(This amendment provides $49.0 million in fiscal year 2027 and $51.8 million in fiscal year 2028 from the general fund to effectuate the provisions of House Bill 1263 of the 2026 General Assembly related to collective bargaining. The bill provides for the creation of the Public Employee Relations Board as well as addresses additional staffing and technology needs required to implement collective bargaining in Virginia. It also establishes the Virginia Home Care Authority within the Department of Medical Assistance Services and tasks the Authority with serving as the public employer of individual providers. This is an estimate of anticipated costs based on prior fiscal impact statements for bills on collective bargaining for state employees and home health care workers.)
