Explanation

(This amendment modifies language in the introduced budget for the Medicaid nursing facility value-based purchasing (VBP) program to ensure that payments are only provided to those facilities that demonstrate a sufficiently high quality of care. The language changes remove broad language which would allow the Department of Medical Assistance Services to make significant changes through internal administrative decisions related to components beyond the basic mechanics of the program, such as the eligibility to participate in the program. Language would allow annual reporting to inform the Governor and General Assembly on potential modifications outside of the basic mechanics of the program as articulated, along with other program evaluation data for legislative action. The amendments also remove broad discretionary statements and instead require the department to properly articulate any requirements in the annual methodology documents. Also, references to the complaint survey process and the Department of Health's Office of Licensure and Certification (VDH OLC) are removed as they are not defined with any specificity, such as being "under complaint surveys" with no consideration of whether the complaint was validated through the formal survey process. Survey information is available federally, and the reference to the VDH OLC is not defined as the the parameters for consideration of eligibility under the VBP.)
