Page 53, after line 39, insert:
"S. Notwithstanding the provisions of paragraph H.1. of this item, the Compensation Board may approve funds for the operational costs, including salaries, for local and regional jail capacity previously constructed with federal funds, where the contract for housing federal inmates under which such capacity was built has expired, and provided such local or regional jail is not exempted from the cost recovery provisions in paragraph H. of Item 69 for housing federal and out-of-state inmates.  Funds for operational costs, including salaries, shall only be approved under this provision subject to appropriations by the General Assembly in Item 68 for this purpose."


Explanation
(This amendment provides staffing for certified jail capacity in the Western Tidewater and Piedmont Regional Jails that is not currently provided by the Compensation Board because such capacity was previously constructed with federal funds for the housing of federal inmates. Such previous contracts have expired and jail beds house state and local responsible inmates. These two jails currently repay overhead costs to the Commonwealth for housing federal inmates, but have never been staffed by the Commonwealth for the beds in which inmates are housed. A companion amendment to Item 68 provides language authorizing staffing and funding necessary to implement the staffing.)
