Page 43, line 17, after "Commonwealth.", insert:
"In the event federal inmates are maintained in alternative to incarceration programs through the jail, the amount to be recovered by the Compensation Board shall be 25 percent of the amount that would be recovered per inmate day if such federal inmates were housed in the jail."


Explanation
(This amendment adds language reducing the recovery of Commonwealth funded overhead costs from jails who provide alternative to incarceration programs for federal inmates who would otherwise be housed in local and regional jail facilities. Currently, the recovery of Commonwealth funded overhead costs are recovered for federal inmates, District of Columbia inmates, and contract inmates from other states as though all such inmates are housed in local and regional jails. The proposed language provides for lesser recovery rate of 25 percent for those days in which federal inmates are maintained in an alternative to incarceration program, such as home electronic monitoring. Currently, Riverside Regional Jail has 15 federal inmates on home electronic monitoring pursuant to a contract with the federal Bureau of Prisons. These inmates are not housed in the jail, and are not likely to be.)
