LLL. From July 1, 2012, until June 30, 2013, the Department of Medical Assistance Services shall reduce payment for level III (CPT Code 90283) emergency department visits that are deemed non-emergencies by half the reduction that would occur under regulations in effect in fiscal year 2012.  Effective July 1, 2013, the department shall not reduce the fee for level III (CPT Code 90283) emergency department visits that are deemed non-emergencies. The department shall have the authority to implement this change prior to the completion of any regulatory process undertaken in order to effect such change."


Explanation
(This amendment provides $318,841 from the general fund and a like amount of federal Medical matching funds each year to offset savings assumed in the Department of Medical Assistance Services budget from reducing payment for claims from emergency room physicians who treat Medicaid recipients when a retrospective review determines that the individual could have received care in an outpatient setting. Emergency room physicians have no choice in treating individuals who present in emergency rooms. Delay of payment for certain "non-emergency" Medicaid claims places an unreasonable financial burden on these providers.)
