"LLL.  The Department of Medical Assistance Services shall amend the 1915 (c) home- and community-based waivers and the Children's Mental Health demonstration grant to increase the annual respite care hours from 480 to 720.  The department shall implement this change effective July 1, 2012 and prior to the completion of any regulatory process undertaken in order to effect such change."


Explanation
(This amendment provides $13.4 million from the general fund and $13.4 million from the nongeneral fund from federal Medicaid matching funds each year to restore the number of hours of respite care that can be provided to the caregiver of a Medicaid waiver recipient from 480 to 720 hours per year. Chapter 890 of the 2011 Acts of Assembly reduced the hours of respite care that can be provided from 720 to 480 hours beginning July 1, 2011.)
