"QQQQQ.1. Effective July 1, 2026, the Department of Medical Assistance Services shall have the authority to increase the rates for agency and consumer-directed personal care, respite and companion services by 20 percent. The department shall ensure that personal care, respite, and companion care agency providers pass through the per hour rate increase to the workers delivering these services. The department shall have the authority to implement these changes prior to completion of any regulatory process to effect such change.

2. Effective July 1, 2027, the Department of Medical Assistance Services shall have the authority to increase the rates for agency and consumer-directed personal care, respite and companion services by five percent. The department shall ensure that personal care, respite, and companion care agency providers pass through the per hour rate increase to the workers delivering these services. The department shall have the authority to implement these changes prior to completion of any regulatory process to effect such change.



Explanation

(This amendment provides $175.5 million GF and $197.9 million NGF the first year to increase personal care, respite, and companion services rates by 20 percent for consumer-directed and agency-directed care. The amendment also provides for $219.7 million GF and $247.7 million NGF the second year, for an additional five percent rate increase. The department must ensure that personal care, respite, and companion care agency providers pass through the rate increase per hour to the rate of the workers delivering these services. Language provides the agency with emergency regulatory authority to implement these changes.)
