"QQQQQ.1. Effective July 1, 2026, the Department of Medical Assistance Services shall have the authority to increase the rates for agency-directed personal care, respite, and companion services by 22.6 percent. The department shall have the authority to implement these changes prior to completion of any regulatory process to effect such change.

Explanation

(This amendment provides $160.2 million GF and $180.5 million NGF the first year and $407.5 million GF and $456.5 million NGF the second year to provide a 22.6 percent rate increase for agency-directed personal care services on July 1, 2026, and on July 1, 2027. This recommendation was made by Guidehouse Consulting based on a legislatively mandated rate study conducted in 2025. This increase is necessary to provide better compensation and cover the increased cost of nursing oversight, insurance, workers compensation, health insurance, electronic visit verification software, rent, and all other direct and indirect costs of care. It also meets the requirements identified in the Permanent Injunction (Civil Action No. 3:12-cv-59-JAG).)
