Effective July 1, 2026, the Department of Medical Assistance Services (DMAS) shall provide guidance to ABA providers and facilities on required ABA documentation and shall coordinate with managed care organizations (MCO) to perform periodic pre- and post-payment reviews of ABA payments. DMAS shall require specific reporting from each MCO that can be analyzed across MCOs, by region, by provider, by diagnosis, by modality, delivery location, and at a statewide level, to assist in identifying approaches to consider to target delivery of ABA to those most in need of the service and to identify appropriate cost containment strategies."



Explanation

(This amendment provides $30.8 million GF and $32.8 million NGF the first year and $36.8 million GF and $39.0 million NGF the second year to reverse the changes included in the introduced budget that requires a diagnosis of autism spectrum disorder for an enrollee to receive applied behavior analysis (ABA) services and sets a 20 hour per week cumulative limit on services provided under ABA. Language requires that the current framework for reimbursement for ABA services is evaluated with evidence-based treatment strategies and supported by data collection. The purpose of this amendment is to develop more targeted treatment approaches, recognized by MCOs, to address patient services based on need and the containment of cost.)
