"QQQQQ. Effective July 1, 2026, the Department of Medical Assistance Services (DMAS) shall increase the vagus nerve stimulator device payment for all acute care hospitals and ambulatory surgery centers (ASC) which participate in Medicaid. DMAS shall modify the HCPCS code for providers to use when billing neurostimulator device components for epilepsy diagnoses only utilizing the procedure code, L8679 with the procedure description “IMP NEUROSTI PLS GN ANY TYPE”, shall be increased by $15,396 per procedure payment for epilepsy diagnosis only. DMAS shall have the authority to implement these changes prior to completion of any regulatory process undertaken to effect such change."



Explanation

(This amendment provides $670,000 GF each year for the Commonwealth to meet the needs of Medicaid beneficiaries suffering from drug-resistant epilepsy who are experiencing an access to care issue. The issues are not based on the recommendations of their physician or epileptologist; rather, the lack of care is due to the current Medicaid hospital payments for a Vagus Nerve Stimulator (VNS) device. Because the payments for the treatment are significantly lower than the cost, patients are often left without the option of VNS or remain on a long waitlist at either VCU Health or UVA Health.)
