Explanation

(This amendment directs the Department of Medical Assistance Services to reimburse Federally Qualified Health Centers (FQHCs) for unreimbursed costs for the two years prior to an initial request for a change in scope under the new process. Reimbursement for services by FQHCs to Medicaid patients are determined through a process that is, in part, directed by federal requirements. One of the requirements is that there must be a “change in scope” process so that, as new services are provided to the community served by a FQHC, the reimbursement rate will reflect those new services. Although Virginia has included “Change in Scope” in its State Medicaid Plan, approved by the federal Center for Medicaid Services, no change in scope process has been available to FQHCs since 2001. As a result, this has resulted in most FQHCs receiving reimbursements below costs each year, limiting FQHCs’ ability to provide increased services for patients. In recent years, the statewide total has been estimated near $4.5 million annually. This amendment reimburses FQHCs for unreimbursed costs for the two years prior to an initial request for a change in scope under the new process. The Centers for Medicare and Medicaid Services has a 24-month limit on when it will match Medicaid DMAS payments.)
