"QQQQQ. Effective July 1, 2026, the Department of Medical Assistance Services shall have the authority to amend the Community Living and Family and Individual Supports 1915c Developmental Disability Waivers and the associated regulations needed to reimburse providers for providing designated staff in an acute care hospital when necessary supports are outlined in the individual's service plan and are not available in that setting, or when the individual requires support for communication and behavioral stabilization and such support is not provided in that setting. Reimbursement shall be based on the personal care rate services described in the individual plan of care for individuals 18 or older in Group Homes, Sponsored Residential, Supported Living or In-Home Services. The department shall have the authority to implement these changes prior to completion of any regulatory process to effect these changes."



Explanation

(This amendment provides $790,000 GF and $810,00 NGF the first year and $820,000 GF and $840,000 NGF the second year for the Department of Medical Assistance Services (DMAS) to amend the Community Living and the Family and Individual Support disability waivers to add an option for supporting participants in an acute care hospital when necessary supports are outlined in the individual's service plan and are not available in that setting, or when the individual requires support for communication and behavioral stabilization and such support is not provided in that setting. Services would be available for those individuals, 18 years of age or older, who are admitted to an acute care setting while receiving Group Home Residential, Sponsored Residential, Supported Living, or In-Home Supports. This will allow providers to support staff who provide the needed supports while an individual is in acute care.)
