Page 135, after line 1, insert:

"K.1. The Department of Education shall examine options to improve the capacity of public school divisions to serve students who are at risk of placements outside the public schools in order to enable those students to remain in the least restrictive environment.  As part of this study, the Department shall review the recommendation from the 2021-2022 Children's Services Act Work Group to create a defined pool of funds within the Department of Education reserved for such students, to include consideration of whether this goal could be achieved by expanding or restructuring the existing Students with Intensive Support Needs Application funding mechanism.

2. In addition, the Department shall review usage of out-of-school placements by school divisions, examine the strategies used by those school divisions that successfully serve students with high levels of support needs within the public school setting, determine what state support might be needed to replicate those successful strategies in other school divisions, and make recommendations to the Governor, the Secretary of Education, the Secretary of Health and Human Resources, the Chair of the Health and Human Services Committee, and the Chair of the Senate Education and Health Committee by November 1, 2026.

3. In conducting this study, the Department shall consult with the staff of the Senate Finance and Appropriations and House Appropriations Committees, the Virginia Council of Administrators of Special Education, the Virginia Association of School Superintendents, the Children's Services Act Coordinators Network, the Virginia Association of Counties, and the Virginia Municipal League, and may consult with additional stakeholders as it deems necessary."



Explanation

(This language-only amendment directs the Department of Education to review options to improve public school divisions’ capacity to serve students at risk of out-of-school placements so they may remain in the least restrictive environment. The review shall include the 2021–2022 Children's Services Act Work Group recommendations to create a defined DOE funding pool, an analysis of out-of-school placement usage, and strategies used by divisions successfully serving students with high support needs in public schools.)
