Page 164, after line 35, insert:

"VV. The Department of Medical Assistance Services (DMAS) shall administer the state pharmacy benefit for all Medicaid recipients and shall develop a Request for Proposal (RFP) for the state pharmacy benefits manager (PBM) and must select a qualified bidder that shares no ownership with any Medicaid Managed Care Organization (excluding Prepaid Ambulatory Health Plan), third party payer, or any licensed pharmacy. DMAS shall contract directly with the state PBM. Furthermore, the qualified bidder must maintain no direct or indirect financial arrangements with drug manufacturers or labelers that create incentives for formulary decisions, drug substitution, or utilization management, including rebates, discounts, chargebacks, claw backs, or data sales. The selection of the state PBM is required to use the ingredient-cost reimbursement based on the national average drug acquisition cost, plus a professional dispensing fee. For the the RFP release, DMAS shall meet the deadline of July 1, 2026, and with a "go live" date no later than January 1, 2027."

(This amendment directs the Department of Medical Assistance Services to contract directly with the state pharmacy benefits manager, which shall be selected through a Request for Proposal that has a number of restrictions.)
