Effective July 1, 2026, the Department of Medical Assistance Services shall amend the State Plan for Medical Assistance under Title XIX of the Social Security Act to eliminate the 7-year bar for lawful permanent residents who otherwise meet all Medicaid eligibility requirements. The department shall have authority to promulgate all emergency regulations to implement this amendment within 280 days or less of the enactment of this act."



Explanation

(This amendment adds funding and language to eliminate the restrictions for certain permanent residents, who otherwise meet all Medicaid eligibility requirements, from receiving Medicaid services unless they reside in the U.S. for seven years. This would impact permanent residents who were admitted to the U.S. such as certain refugees, certain asylees, Cuban-Haitian entrants, Amerasian immigrants, and certain non-citizens whose deportation is withheld.)
