"QQQQQ. The Department of Medical Assistance Services (DMAS) shall develop a Request for Proposal (RFP) for the Medicaid single Pharmacy Benefits Manager which requires that a qualified bidder is one that shares no ownership with any Medicaid managed care organization (excluding a prepaid Ambulatory Health Plan), third party payer or any licensed pharmacy. Furthermore, a qualified bidder must maintain no direct or indirect financial arrangements with drug manufacturers or labelers that create incentives for formulary decisions, drug substitution, or utilization management, including rebates, discounts, chargebacks, claw backs, or data sales. The RFP shall include criteria for the selection of the state Pharmacy Benefits Manager that requires the use of ingredient-cost reimbursement based on the national average drug acquisition cost, plus a professional dispensing fee. The RFP must be released by July 1, 2026, and with an implementation date no later than January 1, 2027."



Explanation

(This amendment provides $1.0 million from the general fund the first year for the cost to the Department of Medical Assistance Services to issue a Request for Proposal for a single Pharmacy Benefits Manager (PBM). The amendment adds language specifying provisions of a qualified bidder for the selection of a PBM and requires the release of the RFP by July 1, 2026 and implementation by January 1, 2027.)
