"QQQQQ.  The Department of Medical Assistance Services shall seek federal authority through the necessary waivers and state plan amendments to allow respite care for all legally responsible individuals providing care to children through the Developmental Disability Waiver programs and the Commonwealth Coordinated Care Plus Waiver, allowing for consistent application across the waiver programs."

Explanation

(This amendment provides $4.5 million from the general fund and $5.2 million from nongeneral funds each year to provide respite care services to Legally Responsible Individuals (LRIs) who are paid caregivers for children receiving services through the Medicaid Developmental Disability (DD) Waiver programs or and Commonwealth Coordinated Care (CCC) Plus Waiver. LRIs are defined as parents of minors under the age of 18 and spouses of waiver recipients. Currently, the Medicaid program prohibits respite services when there is a paid LRI providing personal care/assistance.)
