Effective July 1, 2026, the Department of Medical Assistance Services shall have the authority to amend the State Plan for Medical Assistance and associated regulations to eliminate the requirement that consumer-directed services employees that provide any combination of respite service, personal assistance service, and companion service in the consumer-directed service model shall work for no more than 16 hours per day. The department shall have the authority to promulgate emergency regulations to implement these amendments within 280 days or less from the enactment of this act."



Explanation

(This amendment provides $8.6 million from the general fund and $9.4 million from nongeneral funds each year to eliminate the 16-hour per day cap on the number of hours per day that a consumer-directed services employee may provide any combination of respite service, personal assistance service and companion service through the consumer-directed service model and receive Medicaid reimbursement for such services. The amendment provides the Department of Medical Assistance Services with emergency regulatory authority to implement such change.)
