Effective July 1, 2026, the Department of Medical Assistance Services shall have the authority to increase the developmental disability waiver rates by five percent for the following services: Group Day, Group Homes, Group Supported Employment, Peer Mentor, Service Facilitation, Sponsored Residential, Supported Living and Transition Services, and Crisis Services.  The department shall have the authority to implement these changes prior to the completion of any regulatory process to effect such change."



Explanation

(This amendment adds $33.0 million from the general fund and $33.0 million from nongeneral funds each year to increase the rates for Group Day, Group Homes, Group Supported Employment, Peer Mentor, Service Facilitation, Sponsored Residential, Supported Living and Transition Services, and Crisis Services provided through the Medicaid Developmental Disability (DD) Waiver programs, using the 2025 DD Waiver rate study. The rate study was conducted pursuant to the Permanent Injunction (Civil Action No. 3:12CV59-JAG), but rate increases for these two services provided through the DD Waiver programs were not included in the introduced budget. Funding does not provide for a rate increase for these services provided through other long-term care waiver programs.)
