"C. The Crime Commission shall submit a comprehensive statistical review of children under 18 years of age who are subject to prosecution and incarceration as adults in the Commonwealth, which shall be completed by July 1, 2027, and shall analyze data from calendar years 2021 through 2026.

Such statistical review shall include (i) the number of children eligible for transfer to circuit court for prosecution in the calendar year; (ii) the number of children transferred from juvenile and domestic relations district court to circuit court for prosecution in the calendar year and the offenses they were charged with; (iii) the number of children indicted in circuit court in the calendar year and the offenses they were charged with; (iv) the number of children convicted in circuit court in the calendar year and the offenses they were charged with; (v) the average age of a child at the time of the commission of the offense; (vi) the age of the child at the time of conviction; (vii) demographic information, including race, ethnicity, nationality, disability, gender, sex, and gender identity of each child; (viii) the length of active time or sentence each child in the custody of the Department of Juvenile Justice or Department of Corrections has been ordered to serve upon conviction for his offense; (ix) the nature and location of each child's sentence following conviction in circuit court, such as immediate custody in the Department of Corrections, immediate jail time, immediate placement on adult probation, commitment as a serious juvenile offender, or a blended sentence of commitment to the Department of Juvenile Justice followed by active time in the Department of Corrections; (x) the number of people incarcerated in the Department of Corrections for crimes they committed as children; (xi) demographic information, including race, ethnicity, nationality, disability, gender, sex, gender identity, current age, and age at the time of conviction for each person currently incarcerated in the Department of Corrections for crimes committed as children; and (xii) the offense and corresponding sentence each person incarcerated in the Department of Corrections is serving for a crime he committed as a child.

All agencies of the Commonwealth shall provide assistance to the Commission for such statistical review upon request, including the Executive Secretary of the Supreme Court of Virginia, the Department of Corrections, the Department of Juvenile Justice, and the Virginia Criminal Sentencing Commission. Such statistical review shall be included as part of the annual executive summary."



Explanation

(This amendment provides $50,000 in the first year from the general fund and directs the Virginia State Crime Commission to conduct a comprehensive statistical review of children under 18 years of age who are subject to prosecution and incarceration as adults in the Commonwealth.)
