Page 191, after line 11, insert:

"R. To assist with availability and allocation of Water Quality Improvement Fund grants, for any Enhanced Nutrient Removal Certainty Program upgrades undertaken by the Hampton Roads Sanitation District pursuant to § 62.1-44.19:14 G1 through G3, Code of Virginia, including but not limited to SWIFT nutrient upgrades, for which the Department of Environmental Quality enters into a grant agreement on or after January 1, 2026, payment of Water Quality Improvement Fund grants to the Hampton Roads Sanitation District shall be capped at $190,000,000 million per year from fiscal year 2026 through and including fiscal year 2031, notwithstanding any higher amount that may be due to Hampton Roads Sanitation District under applicable grant agreements. Any amounts that are due but unpaid in any fiscal year as the result of the operation of the annual cap shall be deferred to and reimbursed in the next fiscal year. It is the intent of the General Assembly to provide sufficient annual allocations to the Water Quality Improvement Fund to reimburse the Hampton Roads Sanitation District for its grant eligible costs in the amount of $190,000,000 per year through fiscal year 2031, at which time the Department of Environmental Quality's normal grant reimbursement procedures shall resume. The conditions and limitations of paragraph I of this item shall not apply to the projects covered by this paragraph."



Explanation

(This amendment establishes an annual aggregate reimbursement cap of $190 million for certain wastewater treatment plant upgrades required by the the Enhanced Nutrient Removal Certainty Program for which the Department of Environmental Quality enters into a grant agreement on or after January 1, 2026.)
