"WWWW.  The Department of Medical Assistance Services shall develop an exceptions process to the weekly hourly cap on the number of hours a consumer-directed attendant can work for the same employer of record.  Exceptions shall be limited to adults with disabilities who live alone and due to extraordinary disability factors need to hire the same consumer-directed attendant for more than the 40 hour weekly cap. The exceptions process shall apply only in situations in which the individual is not able to hire multiple attendants due to extensive training needs, rural location, rare circumstances such as an illness or weather emergency and other situations determined by the department during the promulgation of regulations to establish the exceptions process.  The department shall promulgate regulations to implement these provisions to be effective within 280 days of its enactment."



Explanation

(This amendment would require the Department of Medical Assistance Services (DMAS) to develop an exceptions process to the weekly hourly cap on the number of hours a consumer-directed attendant can work for the same employer of record and authorizes DMAS to pay overtime wages in these situations.)
