Page 321, after line 22, insert:

"U.  The Department of Behavioral Health and Developmental Services shall notify participants in the Developmentally Disabled Waiver programs of their Supports Intensity Scale (SIS) score, tier and appeal rights, and be provided a copy of the SIS questions in advance of their meeting with the assessor as well as any standard operating procedures for the SIS assessment process.  Participants shall have the right to appeal their SIS score up to 90 days after receiving notification of the assigned SIS score and tier.

V.  The Department of Behavioral Health and Developmental Services shall report on (i) services being requested by individuals on the Developmentally Disabled Waiver waiting list, (ii) the age and demographics of waiting list individuals and families, and (iii) the number of individuals who meet each of the criteria items for Priority 1.  The department shall submit this report by July 1 of each fiscal year to the Chairman of the House Appropriations and Senate Finance Committees.

W.  The Department of Behavioral Health and Developmental Services shall provide a detailed report on the population served by the Developmentally Disabled Waiver programs and budget by October 1 of each fiscal year to the Chairman of the House Appropriations and Senate Finance Committees.  The report shall include detailed information on demographics, SIS scores, service utilization and expenses for the following cohorts:  (i) individuals who have used waiver services for less than one year and (ii) individuals who have used waiver services for 1-5 years."



Explanation

(This amendment requires the Department of Behavioral Health and Developmental Services to notify individuals in the Developmentally Disabled Waiver programs specific information related to their needs assessments and provide information on how the process works and on their appeal rights. Language extends the appeal period. In addition, language requires reports on the DD waiver program in July and October.)
