Page 372, after line 12, insert:

"M.  Notwithstanding any other provision of law, no funding appropriated to any agency of the Commonwealth for transportation purposes may be expended for the planning, design, engineering, or construction of, or for the procurement of goods and services to undertake any such activities to convert any existing or planned travel lanes on Interstate 66 east of mile marker 40, the Haymarket/Route 15 interchange, to high occupancy toll (HOT) lanes unless such HOT lanes preserve the right of high occupancy vehicles (HOV) with a minimum of two passengers and vehicles with Clean Fuel Vehicle license plates to use the HOT lanes free of charge.  Such prohibition shall extend to the use of staff time related to such a project."



Explanation

(This amendment prohibits the use of any general or nongeneral transportation funds to convert any existing or new travel lanes of Interstate 66 east of mile marker 40 (Haymarket/Route 15) to high occupancy toll (HOT) lanes unless HOV and clean fuel vehicles are authorized to utilize the HOT lanes free of charge.)
