Explanation

(This amendment provides an appropriation to the Corrections Special Reserve Fund to reflect the estimated impact on utilization of beds in the Commonwealth’s Adult Correctional Centers resulting in changes in criminal sentencing pursuant to House Bill 752, which creates a presumption that if a victim of stalking provides actual notice to the defendant that he or she does not wish to be contacted or followed, later contact or following by the defendant is prima facie evidence the defendant intended, or reasonably should have known, that the victim was thereby placed in reasonable fear of death, sexual assault, or bodily injury. House Bill 752 is a recommendation of the Virginia State Crime Commission.)
