"G.  Out of this appropriation, $4,789,000 the first year and
$4,789,000 the second year from the general fund shall be provided pursuant to § 58.1-3403 of the Code of Virginia as service charge payments to the four localities impacted by tax-exempt Virginia Port Authority operations, marine terminals and facilities located within their boundaries.  Notwithstanding the provisions of subsection D of
§ 58.1-3403, the Virginia Port Authority shall pay to the host localities the full amount required by § 58.1-3403 as it was effective on June 30, 2000 except during a fiscal year that the Commonwealth has fully-funded the service charge formula established by subsection D of § 58.1-3403 in which case such payments shall be governed by § 58.1-3403 as it is effective under current law.  Provided, however, the Virginia Port Authority shall not be required to pay the host localities any funds which would bring total payments to the host localities in any fiscal year to an amount which is greater than they would be entitled to when the service charge established in subsection D of § 58.1-3403 is fully-funded."
