Page 257, after line 7, insert:
"HH. The Department of Medical Assistance Services, in cooperation with affected provider groups, shall conduct a study:  (i) to identify specific types of extraordinary circumstances, if any, that warrant additional reimbursement to a nursing facility and the process by which such additional reimbursement would be provided; (ii) to review the current process for establishing and utilizing ‘calculated’ per diem rates to determine if changes could be made to make the rates closer to the ‘actual’ rates and balance the financial impact that the use of ‘calculated’ rates has on nursing facilities and DMAS; and (iii) to review the current requirement that nursing facilities must increase bed capacity by 50 percent in order to be considered as a new facility for reimbursement purposes.  DMAS shall report its findings and recommendations to the Governor and to the Chairmen of the House Appropriations Committee, the Senate Finance Committee, and the Joint Commission on Health Care by October 1, 2002.”
