"J.1.  The Governor is hereby authorized to allocate a sum of up to
$101,250,000 from this appropriation to the extent necessary to offset downward revisions of the general fund revenue estimate prepared subsequent to February 11, 2002, for fiscal years 2003 and 2004.  If the general fund revenue estimates prepared subsequent to February 11, 2002, do not result in downward revisions for fiscal years 2003 and 2004, then such appropriation shall be used only for employee compensation purposes as follows:
2. For state employees as established in subparagraphs 2 a through 2 d of paragraph B of this item, an amount estimated at $30,734,542 the second year for a November 25, 2003, salary adjustment.
3. For state-supported local employees as set out in subparagraph 2 e of paragraph B of this item, an amount estimated at $10,292,868 the second year for a December 1, 2003, salary adjustment.
4. For faculty of state-supported higher education institutions, an amount estimated at $22,184,000 the second year for a November 25, 2003, salary adjustment.
5.a. For public school employees, an amount estimated at $38,038,590 the second year from the general fund, which is the equivalent payment for the following salary increase and related fringe benefit costs for public school employees, including instructional and support personnel funded through the Standards of Quality.
b. For the second year, the state share of a payment equivalent to a 2.75 percent salary increase December 1, 2003.
c. The intent of the General Assembly is that the average classroom teacher salary be improved throughout the state by at least 2.75 percent the second year.  Sufficient funds are appropriated in this act to finance, on a statewide basis, the state share of such salary increase to school divisions which certify to the state Department of Education, no later than  March 1, that increases have been granted in the fiscal year in which such payments are provided.
d. The state payment includes the state share of salary increases and related fringe benefit costs for not only classroom teachers, but all instructional and support positions required by the Standards of Quality.
e.  This funding shall be matched by the local government, based on the composite index of local ability-to-pay.
f.  This funding is not intended as a mandate to increase salaries."


Explanation
(This amendment provides for a revenue reserve in the event of a downward to the official revenue estimate. If such funds are not used for this purpose, the Governor shall use the appropriation to provide a 2.75 percent salary increase for state employees, state-supported local employees, higher education faculty, and public school teachers in the second year.)
