Item 4-1.09

Item 4-1.09

§ 4-1.09 APPROPRIATION REDISTRIBUTION

a. No expenditures shall be made from appropriations designated in this act as Executive Management, Program 71300. Each agency having such an appropriation shall present a plan prior to the beginning of the second fiscal year to the Director, Department of Planning and Budget, in accordance with instructions issued by him, whereby the full amount of the appropriation shall be redistributed to other appropriations of the agency.

b. In effecting the redistribution of appropriations, the Director, Department of Planning and Budget, is authorized, during the course of each fiscal year, to revise any agency's original redistribution plan, as necessary, for subsequent events and to appropriate any additional nongeneral fund revenues generated by an agency as a replacement for general fund appropriations of that agency.

c. In the event that actual general fund revenue collections for the first year exceed the official estimate of general fund revenue for the first year as shown in the second enactment of this act, the Governor may appropriate all or a portion of such excess to state agencies up to the amount designated for each agency in the Executive Management Program (Program 713) in this act.

d. State agencies having revenue-producing strategies within their approved productivity savings plans as required by Item 541 of this act or associated with appropriation redistribution actions required by Executive Management Program 71300 shall report quarterly to the Director, Department of Planning and Budget, on their progress toward meeting the required revenue collections.
