"S. The Office of the Executive Secretary of the Supreme Court (OES), in collaboration with the Department of Behavioral Health and Developmental Services (DBHDS), shall study existing jail diversion programs for individuals with a serious mental illness in the Commonwealth and other states, and the feasibility of implementing an expedited diversion to court-ordered treatment (EDCOT) process to divert individuals with a serious mental illness to court-supervised mental health treatment. In conducting such study, OES and DBHDS shall (i) identify existing statewide jail diversion programs and initiatives for individuals with a serious mental illness in the Commonwealth and determine the scope and effectiveness of such programs and initiatives, including the populations served; (ii) determine the extent to which an EDCOT process could divert individuals with a serious mental illness who are not served by existing statewide diversion programs and initiatives in the Commonwealth; (iii) identify diversion programs in other states that may more effectively and efficiently serve individuals with a serious mental illness not currently served by existing statewide diversion programs in the Commonwealth who would be diverted to mental health treatment through an EDCOT process, if implemented in the Commonwealth; (iv) identify legal, operational, financial, and other barriers to implementation of an EDCOT process in the Commonwealth and determine how they could be addressed to successfully implement such process in the Commonwealth; and (v) determine the feasibility of implementing an EDCOT process or similar diversion program in the Commonwealth to allow for diversion of individuals with a serious mental illness not currently served by existing statewide diversion programs."



Explanation

(This amendment provides $50,000 the first year from the general fund to support administrative costs associated with performing a study of an expedited diversion to court-ordered treatment (EDCOT) process. This amendment is a placeholder until a fiscal impact is determined.)
