"U.1. The Chairs of the House Appropriations and Senate Finance and Appropriations Committees shall each appoint up to five members from their respective committees to a Joint Subcommittee on Elementary and Secondary Education Funding to provide on-going direction and oversight of the Standards of Quality funding cost policies and to make recommendations to their respective committees to transition to a student-based K-12 funding formula for the Commonwealth in order to improve student outcomes.

2.a. As part of its oversight, the Joint Subcommittee shall establish a work group to study the options and determine the actions necessary to transition to a student-based funding formula for the Commonwealth. The workgroup shall be comprised of: (i) Two members of the House Education Committee, one from the majority party and one from the minority party, appointed by the Speaker of the House of Delegates, (ii) Two members of the Senate Education and Health Committee, one from the majority party and one from the minority party, appointed by the Senate Committee on Rules, (iii) One staff member from each of the House Appropriations and Senate Finance and Appropriations Committees, (iv) the State Superintendent of Public Instruction, (v) the State Secretary of Education, (vi) one representative from the State Board of Education, appointed by the President of the Board, (vii) two representatives of local governments, one appointed by the Virginia Municipal League and one appointed by the Virginia Association of Counties, (viii) one Virginia business leader, appointed by the Virginia Chamber of Commerce; (ix) four parents of students who attend public school in Virginia, from different regions of Virginia, appointed by the Virginia Parent Teacher Association, (x) eight representatives from local school divisions, appointed by the Superintendent of Instruction with consideration of their division's ability to leverage state funds to maximize student outcomes, and to include two local school board members, one from a small, rural school division and one from a large, urban school division, two local superintendents, one from a small, rural school division and one from a large, urban school division, two Chief Financial Officers of local school divisions, one from a small, rural division and one from a large, urban school division.

b. In studying the options, the work group shall: (i) consider findings from the Joint Legislative Audit and Review Commission's July 2023 report, “Virginia's K-12 Funding Formula", (ii) determine what, if any, additional ROI analysis is necessary to develop a student-based funding formula, (iii) review examples from other states that have transitioned to student-based funding formulas, (iv) consider data tools, data systems, and training necessary to support transition to a student-based funding formula, and (v) consult with national experts from not-for-profit or research organizations on best practices in public education finance.

c. The workgroup shall submit recommendations for the Joint Subcommittee no later than October 1, 2024, as to (i) what, if any, additional or updated ROI analysis is necessary to develop a student-based funding formula for the Commonwealth, (ii) what, if any, additional public engagement is necessary to support transition to a student-based funding formula for the Commonwealth, (iii) what data tools, data systems, and training will be necessary to support transition to a student-based funding formula for the Commonwealth and (iv) what next steps the Joint Subcommittee should take to develop a student-based funding formula for the Commonwealth.

d. The Joint Subcommittee shall: (i) determine the appropriateness of implementing each recommendation or policy option, (ii) propose appropriate amendments to each recommendation or policy option, and (iii) develop a plan for the phased implementation of its recommendations.

3. The Joint Subcommittee shall submit initial recommendations and an implementation plan to the Governor and the Chairs of the House Appropriations and Senate Finance and Appropriations Committees no later than November 1, 2024.

4. The school divisions, staff of the Virginia Department of Education, and staff of the Joint Legislative Audit and Review Commission are directed to provide technical assistance, as required, to the Joint Subcommittee and workgroup."



Explanation

(This amendment directs the Joint Subcommittee on Elementary and Education Funding to develop recommendations to transition to a student-based K-12 funding formula and establishes a 23-member workgroup to advise the Joint Subcommittee.)
