"B. Notwithstanding any other provision of law, the Department of Transportation shall neither impose nor execute any contractual agreement that would require the imposition of tolls or other direct user fees on any highway, tunnel or bridge segment in Planning District 23 where the Hampton Roads Transportation Accountability Commission has funded improvements to that segment without a prior executed binding agreement between the Department of Transportation and the Hampton Roads Transportation Accountability Commission regarding the rate and distribution of the toll revenues."

Explanation

(This amendment directs the Virginia Department of Transportation to execute a binding agreement with the Hampton Roads Transportation Accountability Commission relating to the establishment of toll rates and project selection prior to any potential monetization of actively managed toll lanes constructed with HRTAC dedicated revenues.)
