Page 278, after line 4, insert:

“PPP.  Effective July 1, 2018, the Department of Medical Assistance Services shall amend the State Plan for Medical Assistance to increase the formula for indirect medical education (IME) for freestanding children's hospitals, that file out-of-state cost reports, with greater than 50 percent Medicaid utilization in 2009 as a substitute for DSH payments. The formula for these hospitals for indirect medical education for inpatient hospital services provided to Medicaid patients but reimbursed by capitated managed care providers shall be identical to the formula for Type One hospitals. The IME payments shall continue to be limited such that total payments to freestanding children's hospitals, that file out-of-state cost reports, with greater than 50 percent Medicaid utilization do not exceed the federal uncompensated care cost limit to which disproportionate share hospital payments are subject, excluding third party reimbursement for Medicaid eligible patients. The department shall have the authority to implement these changes effective July 1, 2018, and prior to completion of any regulatory action to effect such changes.”



Explanation

(This amendment directs the Department of Medical Assistance Services to maximize payments through Medicaid Indirect Medical Education (IME) payments to children’s hospitals with high Medicaid utilization in lieu of Disproportionate Share Hospital (DSH) payments. IME payments are not limited like DSH (which is subject to an annual allotment). DSH payments are also slated for reduction per the Affordable Care Act. This language allows Children’s National Medical Center (the only hospital to qualify) to maintain their overall funding level from the Commonwealth.)
